These Terms constitute a legally binding agreement between you ("User", "you", or "your") and KraftPixel Digital Solutions Pvt Ltd, a company incorporated under the laws of India ("KraftPixel", "we", "our", or "us"), with respect to your use of the SiteGardenr software and website at sitegardenr.com (collectively, the "Service").

By downloading, installing, accessing, or purchasing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

SiteGardenr is a desktop SEO crawler application that allows users to crawl, audit, and analyse websites for technical SEO purposes. The application runs locally on your device. Features include but are not limited to:

• High-performance concurrent crawling powered by a Rust engine
• On-page SEO metadata extraction
• Redirect chain tracking and canonical URL auditing
• Integration with Google Analytics 4, Google Search Console, and PageSpeed Insights
• 3D site graph visualisation
• Custom data extraction and MCP server support
• CSV export and reporting

We reserve the right to modify, update, or discontinue any feature of the Service at any time. We will endeavour to notify users of significant changes.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are purchasing on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

3. License

3.1 Grant of License

Upon successful purchase and payment, KraftPixel grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the SiteGardenr application on devices you own or control, solely for your internal business or personal purposes, in accordance with the plan you have purchased.

3.2 Restrictions

You may not:

• Copy, modify, adapt, translate, or create derivative works of the software.
• Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the software.
• Sublicense, sell, resell, rent, lease, or transfer your license to any third party.
• Use the Service to build a competing product or service.
• Share your license key or access credentials with any third party.
• Use the Service in any unlawful manner or in violation of any applicable regulations.

4. Acceptable Use

You agree not to use the Service to:

• Crawl websites without proper authorisation from the website owner.
• Violate any website's robots.txt directives or terms of service.
• Conduct denial-of-service attacks or overload third-party servers.
• Collect or harvest personal data in violation of applicable privacy laws.
• Engage in any activity that is illegal, harmful, or infringes on the rights of others.

You are solely responsible for your use of the Service and for ensuring your crawling activities comply with applicable laws and the terms of any third-party websites you access.

5. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account at [email protected]. KraftPixel will not be liable for any loss resulting from unauthorised access to your account due to your failure to safeguard your credentials.

6. Pricing and Payment

All prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes unless stated otherwise. Goods and Services Tax (GST) may be added at checkout where applicable.

Payment is processed securely through Razorpay. By providing payment information, you authorise KraftPixel to charge the applicable fees. All sales are subject to our Refund Policy.

For subscription plans, your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel your subscription at any time from your account settings.

7. Intellectual Property

The Service, including all software, documentation, graphics, logos, and trade marks, is the exclusive intellectual property of KraftPixel Digital Solutions Pvt Ltd and its licensors, and is protected by Indian and international intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you. The "SiteGardenr" name and logo are trade marks of KraftPixel Digital Solutions Pvt Ltd and may not be used without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KRAFTPIXEL DIGITAL SOLUTIONS PVT LTD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts located in India. Nothing herein prevents either party from seeking injunctive relief in any competent court.
